The Supreme Court on Tuesday declined to expedite the resolution of President Donald Trump’s claim of absolute immunity from a state criminal investigation into his finances, indicating that the issue may not be resolved before the November election.
The justices rejected the president’s emergency appeal of an Oct. 23 ruling by lower court judges in New York who refused to dismiss a grand jury subpoena for eight years of his financial records. Trump had argued that the subpoena should be blocked because he enjoys absolute legal immunity while president from “criminal process” such as a grand jury probe.
The court gave no explanation for its ruling, but the decision means that the dispute over the grand jury subpoena is likely to drag on for months. Justice Clarence Thomas, joined by Justices Samuel Alito and Neil Gorsuch, said he would have granted the emergency appeal.
