Donald Trump’s lawyers are asking the Supreme Court to, for the first time in history, consider a dispute between a sitting president and a state prosecutor over claims of immunity from criminal investigation. In a Friday filing, Trump’s lawyers argued that hearing their request to block a criminal subpoena from a New York state prosecutor would present “momentous and historic questions about the separation of powers between the Executive and Judicial branches.” The prosecutors argue that the issue “Simmer[s] with the long-settled principle that no citizen, not even the President, is above the law.” It remains to be seen whether the Court will hear the case and, if so, which way the court’s conservative majority will rule.
